How to Qualify for Bankruptcy

If you are struggling with overwhelming debt, you may be wondering if bankruptcy is an option that will work for you. However, bankruptcy is not available to anyone -- you must qualify for it through the means test.

What is the Means Test?

The means test is a tool used by bankruptcy courts to determine if bankruptcy is an option available to you and if you have the ability to repay your debt. If you pass the means test, you will be allowed to file for Chapter 7 bankruptcy. If you fail the means test, you still have other debt relief options such as filing for Chapter 13 and more.

How Does The Means Test Work?

To start the process, you must gather your most essential financial data tied to your your income and allowable expenses over the past six months. This information is then compared to the median income for your household size in Louisiana. If your income falls below this benchmark, Chapter 7 qualification is typically granted. However, if it exceeds this threshold, further intricate calculations involving permissible expenses come into play.

Ultimately, this assessment ensures that those truly in need of Chapter 7 relief gain access to it, while those who can repay some debts are guided towards Chapter 13. Given the complexity of the test, seeking guidance from an experienced means test attorney in Baton Rouge is essential.

If you are wondering if you qualify for bankruptcy, call Grand Law Firm at (225) 314-8883 to learn more about the means test and other requirements for filing for bankruptcy in Louisiana.

What Is the State Median Family Income?

The state median income is the median amount of disposable income in the state of Louisiana. If your income is below the state median, you will most likely pass the means test.

For cases filed on or after May 15, 2023, the state median family based on family size is below:

  • 1 earner: $53,028
  • 2 people: $64,762
